The Prevention of Sexual Harassment (PoSH) Act, 2013

The Prevention of Sexual Harassment (PoSH) Act, 2013 is a law in India that protects employees from sexual harassment in the workplace. The act was passed to create a safe and dignified work environment for women. 

What the PoSH Act does 

  • Defines sexual harassment policies, prevention systems, and procedures
  • Requires employers to recognize sexual harassment as misconduct
  • Requires employers to set up an internal complaints committee (ICC) for workplaces with 10 or more employees
  • Requires employers to conduct in-house training programs for employees
  • Requires employers to promote responsible reporting

What the PoSH Act covers 

  • Unwanted physical contact or advances
  • Asking for sexual favors
  • Making inappropriate sexual comments
  • Showing pornography
  • Any other unwelcome behavior of a sexual nature
  • Implied or explicit promise of preferential treatment in employment
  • Threat of detrimental treatment in employment
  • Threats concerning an individual's present or future employment status

Penalties for non-compliance 

  • Fines of up to 50,000 rupees
  • Damages to the complainant
  • Cancellation, withdrawal, or disapproval of a business license
